These Terms of Use explain how you may access and use the Meddle website and application (the Service). By accessing or using the Service, you agree to these Terms of Use.

Key definitions

  • "Meddle", "we", "us": Meddle Australia PTY LTD (ACN 83 694 964 862).
  • "Service": The Meddle intake, matching, and booking platform and related websites, applications, and services.
  • "You": Any individual who accesses or uses the Service, including patients, practitioners, and administrative users.

Eligibility and accounts

  • You must be legally capable of entering into a binding agreement under the laws of Australia.
  • Where you create an account, you must provide accurate information and keep it up to date.
  • You are responsible for keeping your login details secure and for all activity that occurs under your account.
  • You must notify us promptly if you suspect unauthorised access or misuse of your account.

Acceptable use

Without limiting the AUP, you must not:

  • attempt to gain unauthorised access to the Service or related systems
  • interfere with or disrupt the Service, including by introducing malware or overloading systems
  • use the Service in a way that is fraudulent, misleading, or otherwise unlawful
  • attempt to bypass security, rate limits, or access controls.

We may suspend or restrict access where we reasonably believe there is misuse, security risk, or breach of these Terms or the AUP.

By using the Service, you acknowledge that:

  • Meddle processes personal information as described in the Privacy Policy; and
  • additional terms in any applicable Data Processing Agreement or customer contract may also apply.

Information accuracy and completeness

The information on the Service is not comprehensive and is intended to provide a summary of the subject matter covered. While we use reasonable efforts to ensure the accuracy and completeness of the information on the Service, to the extent permitted by law (including the Australian Consumer Law), we make no warranty regarding the information on the Service. You should monitor any changes to the information contained on the Service.

We may, from time to time and without notice, change or add to the Service (including these Terms) or the information, products, or services described in it. However, we do not undertake to keep the Service updated. We are not liable to you or anyone else if errors occur in the information on the Service or if that information is not up to date.

System interference and security

We are not liable to you or anyone else if interference with or damage to your computer systems occurs in connection with the use of the Service or a linked website. You must take your own precautions to ensure that whatever you select for your use from the Service is free of viruses or anything else (such as worms or Trojan horses) that may interfere with or damage the operations of your computer systems.

Availability, changes, and support

  • We aim to operate a reliable Service, but we do not guarantee that the Service will be available at all times or free from faults.
  • Uptime, support targets, maintenance windows, and any service credits are described in the Service Terms & SLA. You can request a copy by contacting info@meddle.com.au.
  • We may update, suspend, or discontinue parts of the Service where reasonably required (for example, for security, performance, or legal reasons). Where changes are material, we will provide notice through the Service or other appropriate channels.

Third-party services

The Service may interoperate with or include links to third-party websites, products, and services. Those links are provided for convenience and may not remain current or be maintained.

Unless expressly stated otherwise:

  • we do not endorse and are not responsible for the content on those linked websites or services
  • we have no control over or rights in those linked websites or services
  • those third parties are responsible for their own terms, privacy notices, and support
  • we are not responsible for the content, security, or performance of third-party services.

Clinical and professional responsibilities

Meddle supports intake, matching, and booking workflows only. It does not provide clinical, medical, or allied health advice.

  • Clinical decisions, care delivery, and compliance with professional and regulatory obligations remain the responsibility of practitioners and customers using the Service.
  • Information surfaced by the Service (for example, matches or availability) is for operational support and does not replace professional judgement.

Intellectual property

  • The Service (including text, software, logos, trademarks, and other content) is owned by or licensed to Meddle and is protected by Australian and international intellectual property laws.
  • You may use the Service and its content only as reasonably necessary to access and use the Service for its intended purpose.
  • You retain rights in content you submit to the Service, but you grant us a non-exclusive, worldwide licence for the term of your use to host, process, copy, and display that content as needed to operate and improve the Service and to meet legal and compliance obligations.

Disclaimers

To the extent permitted by law:

  • the Service is provided on an "as is" and "as available" basis
  • we do not make any guarantee that the Service will be uninterrupted, error-free, or suitable for every purpose
  • we make no warranties or representations about the Service or its content, including but not limited to warranties or representations that they will be complete, accurate, or up to date, that access will be uninterrupted or error-free, or that the Service will be secure
  • we exclude all warranties, representations, and conditions that are not expressly set out in these Terms, including any implied warranties under non-mandatory law.

IN AUSTRALIA, OUR GOODS AND SERVICES COME WITH GUARANTEES THAT CANNOT BE EXCLUDED UNDER THE AUSTRALIAN CONSUMER LAW.

Nothing in these Terms limits or excludes any rights, guarantees, or remedies that cannot be excluded under the Australian Consumer Law or other applicable law. Any and all other warranties or conditions which are not guaranteed by the Australian Consumer Law are expressly excluded where permitted.

Limitation of liability

To the extent permitted by law, including the Australian Consumer Law:

  • our aggregate liability to you in connection with the Service and these Terms, whether in contract, tort (including negligence), statute, or otherwise, is limited to the greater of: (a) AUD $100; or (b) the fees (if any) you have paid to us for the Service in the 3 months immediately before the event giving rise to the claim; and
  • we are not liable for any direct or indirect loss, damage, or expense (irrespective of the manner in which it occurs) which may be suffered due to your use of the Service and/or the information or materials contained on it, or as a result of the inaccessibility of the Service and/or the fact that certain information or materials contained on it are incorrect, incomplete, or not up to date; and
  • we are not liable for any loss of profit, revenue, goodwill, or data, or for any indirect, incidental, or consequential loss or damage.

These limitations do not apply to the extent caused by our fraud, wilful misconduct, or any liability that cannot be limited under applicable law.

Governing law and venue

These Terms of Use are governed by the laws of Australia and, where a specific state or territory must be identified, the laws in force in Western Australia, together with the Australian Consumer Law.

Subject to any mandatory dispute resolution process set out in a separate customer agreement, you submit to the non-exclusive jurisdiction of the courts of Western Australia and the courts of appeal from them.

Changes to these Terms of Use

We may update these Terms of Use from time to time, for example to reflect changes to the Service or legal requirements.

  • When we make changes, we will update the "Last updated" date on this page and, where changes are material, provide additional notice where practicable.
  • If you continue to access or use the Service after updated Terms take effect, you are taken to have accepted the updated Terms.
